Terms & Conditions

1. Definitions
"Customer" means the individual or entity that has requested and agreed to receive services from the Company.
"Works" means all resin bound surfacing, preparation, installation and associated activities described in a written quotation.
"Quotation" means a written estimate issued by the Company setting out the scope, price and conditions of the proposed Works.
"Commencement Date" means the date on which the Company begins physical Works on site.
2. Quotations
2.1 All quotations are valid for 30 days from the date of issue unless otherwise stated in writing.
2.2 Quotations are based on information provided by the Customer and a site survey where applicable. Additional costs may arise if site conditions differ materially from those assessed at the time of quotation.
2.3 Quotations do not include planning fees, building regulation charges or third-party costs unless explicitly stated.
2.4 The Company reserves the right to withdraw or revise a quotation at any time before it has been formally accepted in writing by both parties.
3. Contract Formation
3.1 A binding contract is formed when the Customer accepts a quotation in writing (including email or signed acceptance form) and the Company confirms acceptance.
3.2 These Terms & Conditions form part of every contract between the Company and the Customer.
3.3 Any variation to the agreed Works must be confirmed in writing by both parties before that variation is carried out.
4. Payment Terms
4.1 Unless otherwise agreed in the Quotation, payment terms are as follows:
- A deposit of up to 50% of the total contract value is payable upon acceptance of the Quotation.
- The remaining balance is due on the day of practical completion of the Works.
4.2 Payment may be made by bank transfer, debit card or such other methods as agreed in writing.
4.3 Where payment is not received by the due date, the Company reserves the right to charge interest at 8% per annum above the Bank of England base rate under the Late Payment of Commercial Debts (Interest) Act 1998.
4.4 Title to any materials supplied remains with the Company until payment is received in full.
5. Site Preparation & Customer Responsibilities
5.1 The Customer is responsible for ensuring the site is clear, accessible and safe before the Commencement Date, including the removal of vehicles, garden furniture and any obstacles.
5.2 The Company will carry out reasonable surface preparation as described in the Quotation. Where additional preparation is required due to unforeseen sub-base conditions, the Customer will be advised and additional charges may apply.
5.3 The Customer must ensure unobstructed access to water and power on site where required for the Works.
5.4 The Company accepts no liability for damage to underground services (pipes, cables, drains) that have not been identified to us in advance. The Customer must notify us of any known underground services before Works begin.
6. Workmanship & Materials
6.1 All Works will be carried out using premium resin bound aggregates and UV-stable polyurethane resin systems sourced from approved suppliers.
6.2 Colour and texture of finished surfaces may vary slightly from sample boards due to natural variation in aggregate and the influence of lighting conditions on site.
6.3 The Company reserves the right to suspend or reschedule Works due to adverse weather conditions (including frost, rain or temperatures below 5°C) without liability to the Customer.
6.4 All Works will be carried out in a professional and workmanlike manner in accordance with industry standards.
7. Warranty
7.1 The Company provides a 5-year workmanship warranty on all resin bound surfacing installed by us, subject to the following conditions:
- The surface has been maintained in accordance with our care guidelines.
- The defect is not caused by subsidence, tree root damage, vehicular overloading or third-party interference.
- The Customer has not applied any chemicals, solvents or incompatible products to the surface.
7.2 The warranty does not cover natural weathering, minor colour variation or surface discolouration caused by algae, moss or environmental factors.
7.3 Material warranties are subject to the terms of the manufacturer. The Company will pass on any applicable manufacturer warranty to the Customer.
7.4 To make a warranty claim, the Customer must notify the Company in writing within 30 days of discovering the defect.
8. Limitation of Liability
8.1 The Company's total liability to the Customer for any claim arising out of or in connection with the Works shall not exceed the total contract value paid by the Customer.
8.2 The Company shall not be liable for any indirect or consequential loss, including loss of revenue, loss of use or loss of enjoyment.
8.3 Nothing in these Terms & Conditions limits or excludes liability for death or personal injury caused by our negligence, fraud or any other matter that cannot be excluded by law.
9. Cancellation
9.1 The Customer may cancel the contract by providing written notice to the Company.
9.2 If cancellation is received more than 14 days before the Commencement Date, the Company will refund any deposit paid less any reasonable costs already incurred (materials ordered, surveys conducted).
9.3 If cancellation is received less than 14 days before the Commencement Date, the Company reserves the right to retain the full deposit.
9.4 If Works have commenced, the Customer will be liable for the value of work completed to date plus any materials purchased specifically for the project.
9.5 The Company reserves the right to cancel a contract where unforeseen site conditions make the Works impractical or unsafe. In such cases, any deposit paid will be refunded in full.
10. Disputes
10.1 In the event of a dispute, both parties agree to attempt to resolve the matter informally in the first instance by contacting us at contact@daltexresinexperts.co.uk or calling 0800 038 5746.
10.2 If the dispute cannot be resolved informally within 30 days, either party may refer the matter to a mutually agreed mediator or, where applicable, an Alternative Dispute Resolution (ADR) scheme.
11. Governing Law
These Terms & Conditions and any dispute or claim arising out of them shall be governed by and construed in accordance with the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the courts of England and Wales.
